Overview Of Claim
A Statement of Claim was issued in the Ontario Superior Court of Justice in Hamilton on May 9, 2019, claiming general, special, aggravated, punitive and exemplary damages for negligent design, construction and maintenance of the Red Hill Valley Parkway (“RHVP”).
The plaintiffs, Corrine Klassen, Brian Klassen, Estate of Mark Sholer by his Estate Administrator, Edwin Sholer, Melissa Sholer, Natasha Sholer, and Matthew Sholer, are bringing the Action under the Class Proceedings Act, 1992, on behalf of all persons who drove a motor vehicle on the RHVP after November 1, 2007, and who were involved in a motor vehicle crash and all Family Law Act, R.S.O. 1990 section 61 family members of Class Members.
We are compiling a database of individuals who drove a motor vehicle on the RHVP after November 1, 2007, and who were involved in a motor vehicle crash and family members of the individuals.

Robert Hooper of Grosso Hooper Law and David Thompson of Scarfone Hawkins LLP are lead counsel. They say that this proposed class proceeding represents not only the preferable procedure for dealing with this claim, but the only available procedure presenting an opportunity for redress for the hundreds of individuals affected.
